California recognizes two main types of foreclosure: judicial foreclosure and non-judicial foreclosure (also known as a trustee’s sale or power of sale foreclosure). Judicial foreclosure involves going through the court system, while non-judicial foreclosure is a more streamlined process that does not require court involvement, as long as the mortgage or deed of trust contains a power of sale clause.

The foreclosure process in California typically takes several months. For a non-judicial foreclosure, which is the more common type, the process can take around four to six months from the initial notice of default to the actual foreclosure sale. However, the timeline can vary depending on individual circumstances and any legal actions taken by the borrower or lender.

The main steps in a non-judicial foreclosure in California are as follows: 1) The lender records a notice of default with the county recorder’s office; 2) After a 90-day reinstatement period, the lender can record a notice of trustee’s sale; 3) The property is then sold at a public auction, typically around 20-25 days after the notice of trustee’s sale is recorded.

Yes, there are several options for homeowners to potentially avoid foreclosure in California. These include loan modification, forbearance agreements, short sales, deed-in-lieu of foreclosure, and bankruptcy filing. Additionally, homeowners have the right to cure the default (by paying the outstanding amount owed) up until five days before the foreclosure sale.

After a foreclosure sale in California, the former homeowner has a statutory redemption period (typically three months for non-judicial foreclosures) to reclaim the property by paying the full amount owed, plus costs and fees. If the redemption period expires without redemption, the new owner (typically the lender or a third-party buyer) can initiate eviction proceedings to remove the former homeowner from the property.
